Has Israel’s Legal System Really Protected the Country from International Legal Assault?

The supreme court, the ICC, and the limits of legal solutions.

Let’s now turn back to Hizballah and its cluster bombs. In 2010, an international convention banning these munitions went into effect. Neither Israel nor the U.S. has signed it, but Lebanon has—and has done nothing to stop Hizballah from firing cluster munitions indiscriminately into civilian areas in northern Israel. Nor would signing the convention have protected the two Israeli citizens who were killed by a cluster warhead delivered by an Iranian ballistic missile in March. (Iran hasn’t signed the convention either). Meanwhile, the cluster munitions currently produced by the U.S.—which received much criticism when it supplied them to Ukraine—are far less likely to leave behind unexploded ordnance than the older, more primitive kind used by Hizballah.
